Michael S. DeVincenzo is a first-chair trial and appellate lawyer with more than twenty-five years of experience in high-stakes patent litigation. He has tried cases in federal district courts across the country and before the International Trade Commission (ITC), and he has advocated in several of the more consequential patent appeals in the last decade before the Federal Circuit.
Michael has led patent trial teams for clients including JP Morgan, International Securities Exchange, Teva Pharmaceuticals, and ChanBond Communications, in disputes spanning business methods, financial services products, computer hardware and software, circuitry and electronic components, medical devices, and video, audio, and telecommunications systems. He is equally at home enforcing patents for inventors and portfolio owners and defending operating companies against assertions.
On appeal, Michael was counsel in TLI Communications LLC v. AV Automotive, L.L.C. and McRO, Inc. v. Bandai Namco Games America Inc., two of the decisions that continue to define the boundaries of patent eligibility for software. In Interactive Wearables, LLC v. Polar Electro Oy (No. 21-1281), his certiorari petition drew a rare supporting amicus brief from the U.S. Solicitor General recommending that the Supreme Court take the case. He has also argued successfully before the D.C. Court of Appeals.
Outside the courtroom, Michael counsels patent owners, funders, and investors on portfolio management and patent mining, reissues and reexaminations, the strategic acquisition and monetization of intellectual property rights, and opinions on the validity, scope, and enforceability of patents. He served as General Counsel and Chief Intellectual Property Counsel of an advanced semiconductor materials company, and he brings that in-house perspective to every budget, settlement posture, and trial plan he builds with a client.
Before joining the firm, Michael was a partner at King & Wood LLP and at Goodwin Procter LLP. He earned his J.D. from Fordham University School of Law in 2000 and a Bachelor of Engineering from Stevens Institute of Technology.
Notable Representations
Led the trial team in a multi-defendant patent case that resolved in a nine-figure settlement after the close of plaintiff's case in chief.
Secured summary judgment for Bell Helicopter Textron Inc. against Eurocopter in a case involving patents on helicopter components.
Represented OSRAM in multiple ITC investigations concerning the importation of light emitting diodes.
Obtained an injunction for CardinalCommerce Corp. against its competitor SecureBuy LLC in a software intellectual property dispute.
